The trial of Joey Mawson is ongoing at the court in Nyon, Switzerland, where both prosecution and defence have presented their cases regarding the 2019 allegations. The nurse, who had worked for the Schumacher family for six years, did not report the incident until 2021, fearing for her job following the alleged attack.

Joey Mawson has denied the allegations against him, claiming the sexual encounter was consensual and asserting that he was not aware of his own level of intoxication at the time. The Schumacher family has chosen not to comment on the case, with no representatives present during the court proceedings.

What remains unclear — It is uncertain why the nurse did not report the alleged attack until two years later in 2021.

A racing driver has denied raping a nurse caring for Michael Schumacher at the Formula One legend’s home.

Mawson, a friend of the German racing driver’s son, is accused of raping the nurse twice in a bedroom at the 57-year-old’s mansion in Gland, near Geneva, on November 23, 2019.

The Australian racing driver, who told the judge his career is ‘on hold’, denies the allegations and has claimed that the sex was consensual. 

The court in Nyon, Switzerland heard how the nurse, in her 30s, was carried to her quarters fully clothed after becoming intoxicated with vodka-based cocktails playing pool at Schumacher’s home.

When the nurse woke up, she says she was naked and allegedly could not remember what had happened the night before.

She then spotted blood on her bedsheets and felt pain in her vaginal and anal areas.

She broke down in tears as she recounted the alleged attack in court. She said: ‘I had worked for the family for six years and that night I had been working six days non stop. I was very tired and I had had nothing to eat.

‘When I later asked Joey if anything had happened that night, he said “Yes”. I contacted my doctor and I was then referred to another doctor at the university hospital.

‘I didn’t immediately tell the Schumacher family what had happened. I couldn’t remember anything from the night, I had to ask one of the other staff at the house.

‘They said I was drunk and that Joey had carried me to my room, I woke up naked and when I first contacted Joey to ask him if anything had happened he said “No” but then later said “Yes”.’

Prosecution read out text messages that Mawson had sent the nurse, after the alleged attack, which said: ‘I’m so sorry from the bottom of my heart.’

Mawson has admitted a ‘consensual relationship’ with the woman, and claims to have text messages to back that up.

In his testimony Mawson insisted that the nurse had been ‘flirtatious’ and had instigated kissing and that they had ‘touched each other’s genitals’.

He added: ‘She was not intoxicated, she was alert and conscious, she was flirting and she managed to get her leg on the pool table.

‘You could see from her body language she was being flirtatious. I knocked on her room and she invited me in.’

He added: ‘I hadn’t realised how drunk I actually was. It wasn’t until the next morning that I realised how drunk I had been. 

‘During the night, I had assumed she was less drunk than I realised the next morning.’

Mawson told the court that the nurse had been ‘flirtatious’ and had instigated kissing and that they had ‘touched each other’s genitals’.

He added: ‘She was not intoxicated, she was alert and conscious, she was flirting and she managed to get her leg on the pool table.

‘You could see from her body language she was being flirtatious. I knocked on her room and she invited me in.’

Who is Joey Mawson?

Joey Mawson rose through the racing ranks and competing in several junior championships.

The Australian of Peruvian descent is a double champion of the Australian S5000 Championship.

He regularly competed against his friend Mick Schumacher in the MRF Challenge series, even snatching a title off him.

But he was banned from all racing for three years until 2026 after he was found to have taken a banned substance.

He blamed his girlfriend for recommending the drug Mildronate calling the period ‘the darkest hours, days and months of my life.

‘A living nightmare I couldn’t wake up from for months on end’, he said.

The 29-year-old has already completed more than two-years of the ban and wishes to return to racing, as he apologised for his mistake.

‘I love racing, my passion won’t go away. I miss it everyday so I do hope I can be back in the seat someday’, he said.

In fear of losing her job with the Schumachers, she reported the attack two years later in 2021.

The Schumacher family are not named at all and have not been invited to comment on the case.

No-one from the family was present at the time of the alleged sex attack, according to prosecutors.

The Formula One legend’s health has been shrouded in secrecy ever since his skiing accident in December 2013.

He has not appeared in public since, and his family have protected his privacy at their Lake Geneva home.

But Felix Gorner, a reporter for German broadcaster RTL, revealed Schumacher ‘can no longer communicate verbally’.
